Terms & Conditions
These terms and conditions, together with any documents referred to herein, govern the supply of products listed on our website at www.truebrilliance.co.uk ("Our Site") to you. By placing an order for any products from Our Site, you agree to be bound by these terms and conditions. Please read them carefully before ordering.
Please retain a copy of these terms for your records. By placing an order through Our Site, you confirm that you accept these terms and conditions. If you do not accept these terms, you should not place an order.
1. YOUR STATUS
1.1 By placing an order, you warrant that:
- (a) You are legally capable of entering into binding contracts; and
- (b) You are at least 18 years old.
2. HOW THE CONTRACT IS FORMED
2.1 After placing an order, you will receive an order acknowledgement email confirming receipt of your order. This does not mean that your order has been accepted.
2.2 Your order constitutes an offer to buy the products from us. We accept your offer when we send you a dispatch confirmation email confirming that the product has been dispatched. The contract is formed at that point.
2.3 Each contract applies only to the products confirmed in the relevant dispatch confirmation. Where products are dispatched separately, each dispatch confirmation will form a separate contract in respect of the products specified in that confirmation.
3. CONSUMER RIGHTS AND CANCELLATION
3.1 If you are a consumer, you have statutory rights to cancel certain online purchases within 14 days of receiving your product or products, without giving a reason, subject to the applicable exceptions.
3.2 In addition to your statutory rights, we offer a 30-day return period for eligible products, as set out in our Delivery & Returns policy.
3.3 To exercise your statutory right to cancel, you must notify us clearly of your decision to cancel within the applicable cancellation period. You must then return the product or products to us without undue delay and, in any event, within 14 days of notifying us of your cancellation.
3.4 You are legally obliged to take reasonable care of the product or products while they are in your possession. If you handle them beyond what is necessary to establish their nature, characteristics and functioning, we may be entitled to make a deduction from your refund to reflect any resulting reduction in value.
3.5 Our 30-day return policy does not affect your statutory rights. Certain products may be excluded from the right to cancel where permitted by law, including goods that are made to the consumer's specifications or clearly personalised.
4. AVAILABILITY AND DELIVERY
4.1 Our jewellery is made to order. Estimated delivery timeframes are provided on the relevant product page and may also be confirmed at checkout and in your order confirmation.
4.2 We will endeavour to meet the estimated delivery timeframe provided for your order. If there is a significant delay or we are unable to fulfil your order, we will contact you as soon as reasonably possible.
4.3 Delivery arrangements and applicable delivery charges are set out in our Delivery & Returns policy and at checkout.
5. RISK AND TITLE
5.1 Risk of loss or damage to the products passes to you when the products come into your physical possession, or the possession of a person identified by you to take possession of them, other than the carrier.
5.2 Ownership of the products passes to you once we have received full payment for them.
6. PRICE AND PAYMENT
6.1 Prices are as shown on Our Site at the time you place your order, except in cases of obvious error.
6.2 Prices include VAT where applicable. Any applicable delivery charges will be shown at checkout before you complete your purchase.
6.3 Prices may change at any time, but changes will not affect orders that have already been accepted.
6.4 In the event of an obvious pricing error:
- (a) If the correct price is lower than the price displayed, we may charge the lower price.
- (b) If the correct price is higher than the price displayed, we may contact you for instructions or cancel the order and provide you with a full refund.
6.5 We are not obliged to supply products at an obviously incorrect price where the error should reasonably have been apparent to you.
6.6 Payment must be made using one of the payment methods available through Our Site. Available payment methods may include credit and debit cards, PayPal, Apple Pay and Google Pay.
7. REFUNDS
7.1 Where you exercise your statutory right to cancel an eligible online purchase, we will reimburse you in accordance with applicable consumer law.
7.2 Where a statutory cancellation applies, we will reimburse the price paid for the returned product or products and the cost of standard delivery charged by us. We may withhold reimbursement until we have received the returned product or you have provided evidence that it has been sent back, whichever occurs first.
7.3 You are responsible for the cost of returning products where you cancel your order under the statutory cancellation right, unless the product is faulty or we have agreed otherwise.
7.4 Where a product is faulty, damaged or does not conform to the contract, you retain your statutory rights and we will assess the issue and provide the appropriate remedy in accordance with applicable law.
7.5 Refunds will generally be made using the same payment method used for the original transaction, unless otherwise agreed with you.
8. OUR LIABILITY
8.1 We warrant that products supplied through Our Site will be of satisfactory quality, fit for their usual purpose and as described.
8.2 Nothing in these terms and conditions affects your statutory rights as a consumer.
8.3 Nothing in these terms excludes or limits our liability for:
- (a) Death or personal injury caused by our negligence.
- (b) Fraud or fraudulent misrepresentation.
- (c) Any liability that cannot legally be excluded or limited.
8.4 Subject to clause 8.3, we are not liable for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was formed.
9. IMPORT DUTIES
9.1 We currently deliver within the UK only. If we introduce delivery outside the UK in the future, applicable import duties, taxes or customs charges may apply and may be the responsibility of the recipient.
10. COMMUNICATIONS AND NOTICES
10.1 Communication between you and us will generally take place electronically. By placing an order, you agree that we may communicate with you by email or through other electronic means in relation to your order.
10.2 Notices from you should be sent to info@truebrilliance.co.uk and should include your order number where applicable.
10.3 We may contact you using the email address or other contact details provided when you place your order.
11. TRANSFER OF RIGHTS AND OBLIGATIONS
11.1 The contract is binding on you and us and on our respective successors and permitted assigns.
11.2 You may not transfer, assign or otherwise dispose of your rights or obligations under the contract without our prior written consent.
11.3 We may transfer, assign, subcontract or otherwise dispose of the contract or our rights and obligations under it where reasonably necessary to operate our business, provided that this does not reduce your rights under the contract.
12. EVENTS OUTSIDE OUR CONTROL
12.1 We will not be liable for any failure to perform, or delay in performing, our obligations where that failure or delay results from an event beyond our reasonable control.
12.2 Such events may include strikes, industrial disputes, riots, war, natural disasters, transport or communication failures, government action, interruption of utilities or other circumstances beyond our reasonable control.
12.3 Where such an event affects our ability to perform the contract, our obligations may be suspended for the duration of the event and the time for performance extended accordingly.
12.4 We will endeavour to minimise the effect of any such event and resume performance as soon as reasonably possible.
13. WAIVER
13.1 If we fail to insist upon strict performance of any of your obligations under these terms, or if we fail to exercise any of our rights or remedies, this will not constitute a waiver of those rights or remedies.
13.2 A waiver will only be effective if expressly confirmed by us in writing.
14. SEVERABILITY
If any term of these conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that term will be removed or limited to the minimum extent necessary, without affecting the validity or enforceability of the remaining terms.
15. ENTIRE AGREEMENT
15.1 These terms and conditions, together with any documents expressly referred to in them, constitute the agreement between you and us in relation to your purchase.
15.2 Neither party relies on any statement, representation or promise made before entering into the contract other than those expressly included in these terms or otherwise required by law.
15.3 Nothing in this clause limits or excludes liability for fraud or fraudulent misrepresentation.
16. CHANGES TO TERMS AND CONDITIONS
16.1 We may revise these terms and conditions from time to time to reflect changes in our business, applicable law, technology or the way Our Site operates.
16.2 The terms and conditions in force at the time you place your order will apply to that order, unless a change is required by law or otherwise applies to an existing contract.
17. LINKS TO THIRD-PARTY WEBSITES
Our Site may contain links to third-party websites. These links are provided for convenience only. We are not responsible for the content, availability or privacy practices of third-party websites.
Your statutory rights in relation to products or services purchased from third parties are unaffected.
18. GOVERNING LAW AND JURISDICTION
These terms and conditions and any contract between you and us are governed by the law of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections provided by the law of the country in which you live that cannot lawfully be excluded.
Subject to your statutory consumer rights, the courts of England and Wales will have jurisdiction in relation to any dispute arising from these terms and conditions or any contract between you and us.
