Terms & Conditions

These terms and conditions, together with any documents referred to herein, govern the supply of Products listed on our website www.truebrilliance.co.uk (“Our Site”) to you. By ordering any Products from Our Site, you agree to be bound by these terms and conditions. Please read them carefully before ordering.

Please print a copy for your records. By clicking "I Accept" on the purchasing pages, you confirm your acceptance. If you do not accept these terms, you will not be able to order Products from Our Site.

 

1. Your Status

1.1 By placing an order, you warrant that:

  • (a) You are legally capable of entering into binding contracts; and

  • (b) You are at least 18 years old.

 

2. How the Contract Is Formed

2.1 After placing an order, you will receive an order acknowledgement email confirming receipt. This does not mean your order is accepted.

2.2 Your order is an offer to buy Products from Us. We accept your offer only when we send a Dispatch Confirmation email confirming that the Product has been dispatched. The Contract forms at that point.

2.3 For bespoke Products made to your specifications, the Contract forms when We confirm in writing that We can make the Product to your specifications and a price has been agreed.

2.4 Each Contract applies only to Products confirmed dispatched in the Dispatch Confirmation. Separate Dispatch Confirmations form separate Contracts.

 

3. Consumer Rights and Cancellation

3.1 If you are a consumer, you have the right to cancel the Contract within 14 days starting the day after you receive the Product(s).

3.2 To cancel, you must notify Us in writing (including your order number) and return the Product(s) immediately in the same condition, at your cost and risk.

3.3 You are legally obliged to take reasonable care of the Product(s) while in your possession; failure to do so may result in a claim for compensation.

3.4 You do not have the right to cancel bespoke Products made to your specifications.

 

4. Availability and Delivery

4.1 Delivery dates will be as stated in the Dispatch Confirmation or, if none stated, within 30 days of the Dispatch Confirmation (except bespoke Products, which may take longer).

4.2 We will endeavour to provide an estimated delivery date for bespoke Products after receiving your order, but this date is not binding.

 

5. Risk and Title

5.1 Risk of loss or damage to Products passes to you upon delivery.

5.2 Ownership of the Products passes to you only after full payment has been received.

 

6. Price and Payment

6.1 Prices are as shown on Our Site at the time of your order, except in cases of obvious error.

6.2 Prices include VAT but exclude delivery costs, which will be added during checkout as per our Delivery Guide. Delivery is often free.

6.3 Prices may change at any time, but changes do not affect orders already confirmed by Dispatch Confirmation.

6.4 In case of pricing errors:

  • (a) If the correct price is lower than listed, we will charge the lower price.

  • (b) If the correct price is higher, we may contact you for instructions or cancel the order.

6.5 We are not obliged to supply Products at incorrect (obviously erroneous) prices, even after Dispatch Confirmation, if the error was reasonably apparent.

6.6 Payment must be made by credit or debit card accepted on Our Site.


7. Refunds Policy (Online Sales Only)

7.1 If you cancel within the 14-day cooling-off period and return the Product(s):

  • (a) We will refund the full Product price plus any delivery costs we charged you.

  • (b) You are responsible for return shipping costs.

7.2 For returns due to defect or dispute notified per clause 18, We will assess and notify you if you are entitled to a refund, typically processed within 30 days of confirmation.

7.3 You have 30 days from order date to return defective Products. Refunds include delivery and return costs.

7.4 No refunds are provided for Products without genuine defects or where defects were caused by you.

7.5 Refunds are generally made via the original payment method.


8. Our Liability

8.1 We warrant that Products sold are of satisfactory quality and fit for their common purposes.

8.2 Our liability is limited to the purchase price and foreseeable losses.

8.3 We exclude liability for:

  • (a) Death or personal injury caused by our negligence.

  • (b) Liability under Consumer Protection Act 1987.

  • (c) Fraud or fraudulent misrepresentation.

  • (d) Any liability we cannot legally exclude.

8.4 We are not liable for indirect or unforeseeable losses, including loss of income, business, profits, contracts, savings, data, or wasted time.


9. Import Duty

9.1 For delivery outside the UK, import duties and taxes may apply. You are responsible for these charges.

9.2 We have no control over import charges and recommend checking with your local customs office before ordering.

9.3 You must comply with all applicable laws and regulations in the destination country. We are not liable for your breaches.

 

10. Communications and Notices

10.1 Communication will be mainly electronic. You consent to electronic contracts, notices, and information.

10.2 Notices from you must be sent to customerservice@truebrilliance.co.uk.

10.3 We may contact you via the email or postal address you provide. Notices are deemed received immediately when posted on Our Site, 24 hours after email sent, or 3 days after posting by letter.


11. Transfer of Rights and Obligations

11.1 The Contract binds both parties and their successors/assigns.

11.2 You may not transfer your rights or obligations without our written consent.

11.3 We may transfer, assign, subcontract, or dispose of the Contract or our rights/obligations at any time.



12. Events Outside Our Control (Force Majeure)

12.1 We are not liable for failure or delay caused by events beyond our reasonable control (“Force Majeure Events”).

12.2 Examples include strikes, riots, war, natural disasters, transport or communication failures, government acts, etc.

12.3 Our obligations are suspended during the Force Majeure Event, and performance time extended accordingly.

12.4 We will endeavour to resolve or work around the event.


13. Waiver

13.1 Failure to enforce any term does not waive that right.

13.2 A waiver is effective only if expressly stated in writing.


14. Severability

If any term is found invalid or unenforceable, it will be severed without affecting the remaining terms.

 

15. Entire Agreement

15.1 These terms, and any referred documents, constitute the entire agreement.

15.2 Neither party relies on any prior statements or promises except as stated here.

15.3 No remedies for pre-contractual misrepresentations except fraud.

 

16. Changes to Terms and Conditions

16.1 We may revise terms to reflect market, legal, technical, or system changes.

16.2 You are bound by the terms in force when you order unless a legal or governmental change applies retroactively, or we notify you before Dispatch Confirmation

 

17. Links to Third Party Websites

We may link to third-party websites but disclaim any warranty for Products bought there. Your statutory rights against third parties remain unaffected.

 

18. Governing Law and Jurisdiction

Contracts are governed by English law. Disputes shall be subject to the exclusive jurisdiction of English courts.
